UPDATE:

"It's not a image of the game which we are working on," Kojima Productions producer Ken-ichiro Imaizumi told GameSpot.

As you can see, the mascot--whose name is Ludens--is wearing an extra-vehicular activity suit. Though this is not an image from Kojima's upcoming game, it's possible it contains thematic references to the title. It could also be possible that Ludens shows up in Kojima's new game, either in an official capacity or as an Easter egg.

About Kojima Production, I admit I don't understand copyright too much but, correct if I'm wrong: Kojima's new company is actually using the same name it had back at Konami, right? In other words, Kojima now retains its copyright, or is it? If so, shouldn't this explain why Konami had to remove Kojima Production's logo from all their products recently released? Maybe the reason they didn't explain why they were doing so, is that they were afraid it would've hurted their business giving away that Kojima was leaving Konami.

Well from what we know Konami had a plan to 'restructure' their gaming side to be Mobile First and then rename all divisions as generic Konami Studio numbers.

Insider claims seem to suggest that the higher ups despised the console gaming division and Kojima in particular for trying to keep it alive.

Even while Kojima was still working for Konami it seems he was aware of plans to get rid of his name brand while he was still working for them as the Ground Zeroes mission implies. But he still was intent on working at Konami considering he was completing MGSV and going to embark on Silent Hills next.

But now that he's gone and Konami has no need to lay any claim to his name for whatever reason, Kojima is free to use it. Most likely Kojima kept those rights strictly for him in the first place, as even if he eventually retires or died, there'd be no sense having a Kojima Productions around as he was the creative lead on everything there.

But yes it's understandable from Konami's POV to dissociate Metal Gear from Kojima moving forward... but they went about it in the worst way possible. Even supposing Kojima was going to head off in an amicable way, a good PR handling would've been to keep KP on the cover as his last MG game to hype it up. Then future MGS wouldn't have it as it wouldn't be made by him.

At the end of the day we already know that this breakup was sudden and under hostile conditions, so Konami must've already decided to get rid of the KP name earlier on and take an axe to their console side. Kojima must've retained the rights to his brand long ago when things were rosy.

You know, just before you posted this, I was going to post a theory about Ludens, how Kojima says it isn't Norman Reedus in the suit. I thought that "Ludens" was going to be the name given to whoever wears that suit, and that through a series of games, we'd see different people become Ludens. Though it's also turned out that the face in Ludens is apparently a modified version of Kojima himself.
I had this whole Ghost in the Shell like theory about how the emotions of those who wear the Ludens armor bleed into the thing itself, so it takes on it's own personality in a way, altering whoever wears it. It's also inspired by the old Japanese idea about swords having a sort of spirit or soul to them, that the more they kill, the more they make the wielder want to kill. Mostly it's just me going crazy with my own ideas and theories really though.
